Terms of Service

By creating an account or otherwise affirmatively accepting these Terms, you agree to them and acknowledge the Privacy Policy. If you do not agree, do not create or use an account. You must be at least 18 years old and have legal capacity to enter this agreement. If you use Fibly for an organization, you represent that you have authority to bind it.

Fibly is an AI-assisted productivity workspace for tasks, projects, notes, habits, calendar views and imports, focus sessions, planning, analytics, themes, notifications, music and related features. Some features, plans, integrations and usage limits may be unavailable or change by account, provider or testing stage.

Fibly is an early-stage service being tested and improved. Features may contain defects, change materially or be withdrawn. We will try to give reasonable notice before a material reduction to a paid service, unless an urgent security, legal or provider issue requires faster action.

• Provide accurate registration information and keep it current.
• Protect your password, email account, OAuth account and device sessions.
• Do not share, sell or transfer an account without permission.
• Notify support promptly about suspected unauthorized access.
• You are responsible for activity conducted through your account unless caused by Fibly's breach of an applicable duty.

Free and paid access

Features and AI allowances for each plan are shown on the Pricing page or immediately before checkout. Usage limits can be enforced by feature and billing period. "Free" does not mean every feature or provider cost is unlimited.

Recurring subscriptions

• Stripe processes web payments. When store subscriptions are enabled, Apple or Google processes purchases in its respective mobile app and RevenueCat verifies subscription status. Fibly does not directly receive or store full payment-card details.
• Before checkout, Fibly displays the plan, price, currency, interval, renewal and cancellation terms and asks for separate recurring-billing confirmation.
• A monthly subscription renews each month until cancelled. Taxes may be added or collected as required.
• You authorize the payment provider shown at checkout to charge the selected payment method for disclosed recurring amounts and applicable taxes.

Cancellation, price changes and refunds

• Cancel web subscriptions from account Settings or the Stripe billing portal. Cancel Apple or Google subscriptions in the respective store’s subscription settings. Account deletion does not cancel Apple or Google subscriptions. Cancellation normally takes effect at the end of the paid period.
• Price changes apply prospectively after legally required notice. You can cancel before the new price takes effect.
• Except where law requires otherwise or the payment provider or Fibly states otherwise, fees for a period already started are non-refundable. Store purchases are subject to the applicable Apple or Google refund process. Contact support for billing errors or exceptional circumstances.
• Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including mandatory consumer cancellation, refund or disclosure rights.

You retain ownership of content you submit, subject to third-party rights. You grant Fibly a limited, non-exclusive licence to host, copy, transmit, display, transform and otherwise process that content only as reasonably necessary to provide, secure, maintain and support the Service and comply with law. This licence ends when the content is deleted, except for limited backups, legal retention and de-identified information.

• You represent that you have the rights and permissions needed to submit and process your content.
• You decide what content to store and remain responsible for lawful use and required backups.
• You may download a JSON copy of supported local browser data from Settings. This is not a full account export; cloud account exports are handled by request.
• You can delete your account and associated cloud data in Settings → Account → Delete account. Contact support or privacy if you cannot access your account.

AI output is probabilistic and may be inaccurate, incomplete, biased, outdated or unsuitable. Review prompts, generated content, dates, record targets and proposed actions before using or confirming them. Fibly does not guarantee that output is unique, copyrightable or free of third-party rights.

• AI suggestions do not change records.
• AI-generated content is a draft for your review.
• Reviewed Agent actions are previewed and require confirmation before workspace changes are applied.
• Fibly is not medical, legal, financial, mental-health, or emergency advice and must not be used for high-impact decisions about another person.
• Do not submit credentials, full payment-card data or content you lack authority to process.

You must comply with the Acceptable Use Policy. You may not use Fibly unlawfully, infringe rights, harm others, bypass safeguards or usage limits, access accounts or systems without authorization, distribute malware, scrape or resell the Service without permission, or use AI for prohibited high-impact decisions.

Optional services such as Google, Apple, Spotify, Stripe, RevenueCat, OpenAI and external calendar feeds are governed by their own terms and privacy practices. Fibly is responsible for its own conduct but cannot control an outside provider's availability, account eligibility, policy changes or independent processing. You can disconnect optional integrations.

The Fibly software, branding, interface, documentation and original materials are owned by or licensed to the operator and protected by applicable law. These Terms give you a personal, limited, revocable, non-transferable right to use the Service for its intended purpose. They do not transfer Fibly intellectual property.

If you voluntarily provide product feedback, you allow Fibly to use it without restriction or payment, provided Fibly does not publicly identify you without permission. Report claimed infringement to support@fibly.app with enough information to investigate.

Fibly does not promise uninterrupted, error-free or permanently available service. Maintenance, incidents, provider outages and testing can affect availability. Keep independent copies of critical information. Beta or experimental features may change or end with limited notice.

You may stop using Fibly and request account deletion at any time. Fibly may restrict or terminate access for a material Terms/AUP breach, non-payment, security threat, unlawful conduct, provider requirement or legal duty. Where practical and lawful, Fibly will give notice and a chance to cure or appeal. Urgent risk may require immediate action.

After termination, access ends and data is handled under the Privacy Policy. Limited billing, consent, security, dispute, legal-hold and backup records can remain where reasonably necessary or legally required.

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available." Fibly disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement and quiet enjoyment where those warranties can lawfully be disclaimed. Fibly does not promise that AI output, reminders, notifications, calendar data, analytics or integrations will be accurate, timely or suitable for a particular purpose.

To the fullest extent permitted by law, Fibly will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for lost profits, revenue, opportunity, goodwill or data, arising from the Service. Fibly's aggregate liability relating to the Service will not exceed the greater of CAD $100 or the amount you paid Fibly in the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited, including liability that cannot be limited for fraud, wilful misconduct, gross negligence, death or personal injury, privacy violations, or mandatory consumer rights. The allocation is intended to be reasonable for an early-stage low-cost productivity service.

To the extent permitted by law, you will be responsible for third-party claims and reasonable costs caused by your unlawful content, infringement of third-party rights or deliberate material breach of these Terms. This does not require you to cover claims caused by Fibly's own breach, negligence or misconduct. Fibly will provide reasonable notice and will not settle a covered claim in a way that admits your fault without consent.

These Terms are governed by the laws of Newfoundland and Labrador and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to mandatory consumer rights, disputes may be brought in the courts of Newfoundland and Labrador. This clause does not take away a consumer's right to bring a claim or rely on mandatory law in another jurisdiction where that right cannot be waived.

Before formal proceedings, contact support and allow a reasonable opportunity to resolve the issue informally. This does not shorten a legal limitation period or prevent urgent relief.

Fibly may update these Terms as the Service changes. The version and effective date will be updated. Material changes will be communicated by email, in-product notice or another legally appropriate method before taking effect where required. Fibly will request renewed acceptance where required. If you reject updated Terms, you may stop using the Service and request deletion.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign your account or agreement without permission; Fibly may transfer the agreement as part of an incorporation, financing, reorganization or sale, with notice where required. The Terms, Privacy Policy, AUP and checkout disclosures form the agreement about the Service.
